1. Commercial SaaS Agreement & Scope
These Terms of Service ("Agreement") constitute a binding commercial agreement between VOICHE Inc. ("VOICHE", "we", "us") and the individual or enterprise entity ("Customer", "you") accessing or utilizing the VOICHE Vocal Studio platform, APIs, or website.
2. Mandatory Voice Ownership & Anti-Deepfake Protocol
Zero Tolerance for Non-Consensual Voice Synthesis:
You represent, warrant, and covenant that you possess the full legal right, title, and authority to provide the vocal calibration audio. You may only calibrate models of your own authentic voice.
Strictly prohibited activities include:
- Uploading audio of third parties (celebrities, colleagues, public figures) without documented legal authorization.
- Generating deceptive, fraudulent, or defamatory speech.
- Attempting to bypass security safeguards or rate limiting.
Violations result in immediate permanent account termination, forfeiture of subscription balance, and potential referral to relevant authorities.
3. Intellectual Property Allocation
- Customer Ownership: As between Customer and VOICHE, Customer retains sole and exclusive ownership of all right, title, and interest in and to Customer's original voice recordings, speech scripts, and practice audio takes.
- Platform Ownership: VOICHE retains all right, title, and interest in the VOICHE software, cadence algorithms, speech analysis models, and user interface.
- No Training License: VOICHE receives no right to use Customer audio to train commercial foundational models or third-party datasets.
4. Commercial Terms, Billing & Cancellations
- Starter Tier ($0): Provides 50 starter practice credits, 1 voice clone profile, unlimited recording takes, and YouTube & text script import, at zero cost, no credit card required.
- Studio Pro ($19/mo or $209/yr — 1 month free): Provides 1,500 monthly practice credits, 1 voice clone profile, all 4 delivery cadence presets, full-script batch generation, downloadable master take audio, and everything in the Starter tier.
- Executive Studio ($39/mo or $429/yr — 1 month free): Provides 5,000 monthly practice credits — our highest-volume tier — priority email support, and everything in Studio Pro.
- Credit Booster Packs: On-demand non-expiring credit booster packs ($9 for 500 credits, $24 for 1,500 credits, $59 for 5,000 credits).
- Cancel Anytime: Subscriptions can be canceled at any time in 1 click through the self-service Stripe customer billing portal without penalty.
- Refund Policy: We offer a 14-day money-back satisfaction guarantee for any first-time subscription.
5. Warranty Disclaimers & Limitation of Liability
VOICHE provides the service on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, VOICHE disclaims all warranties of any kind. IN NO EVENT SHALL VOICHE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE TOTAL AMOUNT PAID BY CUSTOMER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
6. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).
